DON’T MENTION THE TREATY

Australia has voluminous national literature on the subject of a Treaty between Aborigines and the federal government. The somewhat tiresome list of reasons why the mainstream believe that a Treaty is not a good idea has never been seriously tested in a logical forum of legal specialists.

Every decade or so, the Treaty idea gets a brief airing, then disappears once more into oblivion. Today, with the focus on Indigenous recognition in the Constitution, the Treaty lobby recognises a rare window of opportunity to do one of two things:

Use constitutional change to embed Indigenous recognition so unambiguously into the Constitution that a Treaty becomes an automatic sequitur to recognition, or

Insist that constitutional recognition will be a sell-out of substantial Indigenous interest, which would be used to dismiss future Treaty demands as irrelevant.
